Yeah, I also bought the black spats in medium. I'm 5'7", 160lbs average fit build. The waist was fine, but I do find them too long. I probably could've settled for a small. I just fold the bottoms in. They actually are long enough to go over my feet to the base of my toes.

@dlm: I'm 5'6" & wear b/w a 32-33" pants/jeans. I bought the Scramble V2.0 in a M and the length goes all the way to midway of my feet when fully stretched out (I have to fold them inwards at the ankle). The waist is snug, but not tight. I probably should've purchased a S. Hope that helps.
